Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the BabyWyze mobile application (the “App”). By downloading, accessing, or using BabyWyze, you agree to these Terms.

1. Who We Are

BabyWyze is an app designed for parents and caregivers to track baby-related information such as feedings, diapers, sleep, growth, and notes.

2. Acceptance of Terms

By using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

3. Eligibility

The App is intended for adults (parents, guardians, and caregivers). You must be at least 13 years old to use the App, and if you are under the age of majority where you live, you may use the App only with permission of a parent or legal guardian.

4. Accounts and Access

Some features may require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and keep it up to date.

5. Your Data and Content

You may enter information such as baby profiles, logs, notes, and journal entries (collectively, “User Content”).

You retain ownership of your User Content. You grant BabyWyze a limited license to host, store, process, and display your User Content solely to operate and provide the App’s features.

You are responsible for the accuracy of information you enter and for ensuring you have the right to use it.

6. Advertising

The App may display ads (including via Google AdMob). Ads may be personalized or non-personalized depending on your device settings and consent, including App Tracking Transparency (ATT) choices.

7. AI Features and Medical Disclaimer

The App may include AI-generated insights or responses. These are provided for general informational purposes only.

BabyWyze does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.

If you think you may have a medical emergency, call emergency services immediately.

8. Acceptable Use

You agree not to misuse the App. For example, you will not:

• attempt to gain unauthorized access to the App, accounts, or systems
• interfere with or disrupt the App (including by introducing malware or automated scraping)
• use the App in any unlawful manner
• reverse engineer or attempt to extract source code except where permitted by law

9. Intellectual Property

The App, including its design, branding, and software (excluding your User Content), is owned by BabyWyze and protected by applicable intellectual property laws.

These Terms do not grant you ownership rights in the App.

10. Third-Party Services

The App may integrate with third-party services (such as advertising or analytics providers). Your use of those services may be subject to their own terms and privacy policies.

11. Disclaimer of Warranties

The App is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, BabyWyze and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) the App.

In any event, BabyWyze’s total liability for any claim will not exceed the amount you paid for the App in the 12 months before the event giving rise to the claim (or $0 if you paid nothing).

13. Termination

We may suspend or terminate access to the App if you violate these Terms or if required for security, legal, or operational reasons.

You may stop using the App at any time.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms at the URL where these Terms are hosted and update the “Last updated” date.

By continuing to use the App after changes become effective, you agree to the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction where BabyWyze is established, without regard to conflict of laws principles.
